Simple Summary

Trust Disputes USA is dedicated to promoting greater access to justice and a better understanding of the law. These Terms & Conditions (as defined below) apply to both TRUSTDISPUTESUSA.COM owned and operated by Trust Disputes USA, collectively referred to as TRUSTDISPUTESUSA.COM. By using the TRUSTDISPUTESUSA.COM site and any of our features or services (including TRUST DISPUTES USA Attorney Directory) you agree to all our terms and conditions that you will find below ("Terms & Conditions"). These Terms & Conditions are our rules for using this website. If you do not agree to any of these Terms & Conditions, you may not use this service.

The Actual Terms

TRUSTDISPUTESUSA.COM are all services provided by Trust Disputes USA. For simplicity, when we refer in these Terms & Conditions to, TRUSTDISPUTESUSA.COM that term also refers to and includes TRUSTDISPUTESUSA, and its owners, managers, partners and employees. 

1) General

Acceptance of Terms

The use of the TRUSTDISPUTESUSA.COM sites is governed by these Terms & Conditions, the various disclaimers appearing on our site and our Privacy Policy. By visiting or using the TRUSTDISPUTESUSA.COM site you agree to be bound by these terms. In addition, you understand that the specific method, features, and services offered on the TRUSTDISPUTESUSA.COM site may be altered, improved, removed, or adapted at any time by TRUSTDISPUTESUSA in its sole discretion and without any notice. If you do not agree with any of these terms, do not use this site.

Not An Endorsement

You agree that you understand that the attorneys who listed in the TRUSTDISPUTESUSA.COM Attorney Database are not affiliated with, employed by, or agents of TRUST DISPUTES USA. Although TRUST DISPUTES USA does require Attorney Members to provide basic information about themselves to TRUST DISPUTES USA, (for example, information about the jurisdictions in which they are licensed, information about areas in which they practice and consider themselves competent and knowledgeable), and although TRUST DISPUTES USA does rely upon and pass on this information to Users for their use, TRUSTDISPUTESUSA does not separately verify this information and makes no representations as to the qualifications of any Attorney Members. No listing of any Attorney constitutes an endorsement, recommendation, or referral of any Attorney Member. Attorney Members do not pay TRUST DISPUTES USA to become a Listed Attorney in the TRUSTDISPUTESUSA.COM site.

In connection with their participation on the TRUSTDISPUTESUSA.COM site. Attorney Network Members do make certain representations and warranties regarding the information they provide about the jurisdictions in which they are licensed to practice law and in good standing (or for the state, province or professional requirements and licensing). Nevertheless, you are encouraged to investigate or perform your own due diligence concerning Attorney Members and their qualifications.

2) Privacy

TRUST DISPUTES USA does its best to protect your privacy with respect to information not otherwise disclosed by you in questions submitted to TRUSTDISPUTESUSA.COM via the contact page.

All of your personal information provided to TRUSTDISPUTESUSA.COM, including email addresses, is concealed from all other Users of the TRUSTDISPUTESUSA.COM site and is never published as part of the Trust Disputes USA Attorney Network search database. TRUSTDISPUTESUSA will not disclose this information to third parties without your permission, except in the following circumstances: (i) to protect ourselves from liability, or (ii) to respond to legal process or to otherwise comply with the law. You have a right of access under data protection legislation to the personal data that we hold about you.

Ownership of Content

TRUST DISPUTES USA will own all rights to the content and will have the sole unrestricted right to use, reproduce, edit, modify, sell, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the submitted content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in any content.

Inappropriate Content

You agree that you will not use the TRUSTDISPUTESUSA site to post any advertisement or other commercial messages. You agree that you will not post any knowingly false, defamatory, inaccurate, abusive, harassing, obscene, sexually-oriented, or threatening message, or material that is illegally invasive of another person's privacy. TRUST DISPUTES USA will attempt to delete any inappropriate posts as quickly as possible; however, submissions are generally posted in real-time and typically are not reviewed by TRUST DISPUTES USA before they are posted to the site. As a User of the TRUSTDISPUTESUSA.COM site, if you see inappropriate content on TRUSTDISPUTESUSA.COM, we would appreciate your bringing such posting to our attention.

Indemnification

You agree that you are solely responsible for anything you post on the TRUST DISPUTES USA site and you agree to indemnify and hold TRUST DISPUTES USA harmless from and against any claim, loss, damage, expense, or liability (including attorney's fees and costs) that may result, in whole or in part, from your posts/submissions or use of the TRUSTDISPUTESUSA.COM site. Use of TRUSTDISPUTESUSA.COM - No Attorney-Client Relationship does not in any way create or establish an attorney-client relationship between you and any listed TRUSTDISPUTESUSA.COM listed Attorney.

3) Unauthorized Use or Access

You agree that your use of the TRUSTDISPUTESUSA.COM site will be limited only to what is contemplated by these Terms & Conditions.

4) Disclaimer of Warranties

TRUSTDISPUTESUSA.COM attempts to include accurate information on its websites, but because of the possibility of human and mechanical error as well as other factors, TRUSTDISPUTESUSA.COM is not responsible for any errors. TRUSTDISPUTESUSA.COM and all material, products and services offered on the TRUSTDISPUTESUSA.COM site are provided "AS IS" and "AS AVAILABLE." YOU USE THE SITES AT YOUR OWN RISK.

UNLESS A WARRANTY IS EXPRESSLY STATED IN THESE TERMS & CONDITIONS, NO OTHER STATEMENT, ASSURANCE, ADVICE, OR INFORMATION OBTAINED BY THE USER FROM TRUSTDISPUTESUSA.COM SHALL CREATE A WARRANTY.

5) Limitation of Liability

TRUSTDISPUTESUSA, ITS AFFILIATES, ANY OFFICER, DIRECTOR, EMPLOYEE, SUBCONTRACTOR, AGENT, SUCCESSOR, OR ASSIGN OF LAWGURU OR ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEY'S FEES AND LOST PROFITS OR SAVINGS) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THIS SITE, REGARDLESS OF ANY NEGLIGENCE ON THE PART OF TRUSTDISPUTESUSA, INCLUDING BUT NOT LIMITED TO THOSE THAT RESULT FROM: (i) THE USE OR INABILITY TO USE THE SITES; (ii) RELIANCE ON THE INFORMATION CONTAINED IN THE SITES; (iii) TRUSTDISPUTESUSA'S SUPPORT TRUSTDISPUTESUSA SERVICES; (iv) ANY GOODS OR SERVICES PURCHASED OR OBTAINED FROM ; (v) MESSAGES, INFORMATION OR ADVICE RECEIVED; (vi) TRANSACTIONS ENTERED INTO THROUGH TRUSTDISPUTESUSA OR THE ATTORNEY NETWORK; (vii) INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE; AND (viii) UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

6) Release

TRUST DISPUTES USA provides the technological foundations or "space" where the public can access both legal information and attorneys. TRUST DISPUTES USA provides the conduit for searching for Attorneys; however, we are not involved in the actual conversation between the Attorney Member and you. TRUST DISPUTES USA does not provide legal advice and is not engaged in the practice of law. We do not monitor, verify, or filter any of the responses from the Network Attorney nor can we guarantee the quality, accuracy, or completeness of any attorney. TRUST DISPUTES USA is neither a lawyer referral service nor engaged in making any recommendations about whether you should use a particular attorney's services or not. You hereby acknowledge the above facts and remise, release, and forever discharge TRUST DISPUTES USA, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, which you ever had, now have, or shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of the use of the TRUSTDISPUTESUSA.COM Attorney database or the relationship between you and any listed Attorney introduced to you through this site. If you are a California resident, you hereby waive the provisions of section 1542 of the California Civil Code, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.“

7) Other Websites

TRUSTDISPUTESUSA.COM may contain links to other websites for which TRUSTDISPUTESUSA does not maintain control. Any concerns regarding any such service or resource, or any link thereto, should be directed to the service or resource.

8) Arbitration

Unless prohibited by law, you agree that any dispute or controversy arising out of these Terms & Conditions or your use of TRUSTDISPUTESUSA.COM, shall be settled by Arbitration to be held in Shasta County, State of California, in accordance with the rules then in effect of the American Arbitration Association. The arbitrator may grant injunctions or other relief in such dispute or controversy. The decision of the arbitrator shall be final, conclusive, and binding. Judgment may be entered on the arbitrator's decision in any court having jurisdiction. The parties shall each pay one-half of the costs and expenses of such arbitration, and each of the parties shall separately pay counsel fees and expenses.

9) Modification of Terms

TRUSTDISPUTESUSA may modify these Terms & Conditions at any time without prior notice. Continued use of this site following any change constitutes your acceptance of the change. We, therefore, ask you to review these Terms & Conditions occasionally to ensure that you are aware of the most recent version.

10) Interpretation of the Terms & Conditions

This agreement shall not be construed against any party, regardless of who may have drafted the Agreement.

11) Attorney Delisting

TRUST DISPUTES USA retains the absolute right to delist any Attorney from the TRUST DISPUTES USA search database without notice or without cause Trust Disputes USA listed Attorneys will hold TRUST DISPUTES USA harmless for any delisting.

12) Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, U.S.A. TRUSTDISPUTESUSA.COM is owned and operated by TRUSTDISPUTESUSA. By using the TRUSTDISPUTESUSA.COM site and any of our features or services (including the Attorney Directory), you agree to all our terms and conditions. These Terms & Conditions are our rules for using this website. If you do not agree to any of these Terms & Conditions, you may not use this service.
